Many games get around that patent by calling it something else. And for the patent side it depends on specifically what WotC has patented in regards to Magic and whether Hex is actually violating those patents or if it is different enough. To be honest I don't think people are confusing Hex for Magic so that seems unlikely is it very similar? Yes, but noone out there is thinking that Hex is Magic the gathering or made by the same company it is very clearly it's own entity even if it is incredibly similar to Magic. Trademark would be more of the "People are confusing Hex for Magic", Patent is more along the lines of "We have a patent on a game with 5 colors" (Which I agree is unlikely) What really matters is if they are suing for a patent violation or trademark.
